1. Who handles your data

The data controller is EDUVARA LTD, a company registered in England and Wales (company number 17387037), with registered office at 3rd Floor, 45 Albemarle Street, London W1S 4JL, United Kingdom. Happy English Kids is a product of Eduvara.

Our data protection contact is Olha Barzik. For any question or request about your data, write to info@happyenglishkids.app.

2. What data we collect

• When you send us a request (information or quote): name, school or organisation, email, role, country, your message, the language of the page, the date of the request and the consent you gave.
• When we create an account for you (licence): name, email, school, the licence assigned to you, and the technical logs of your access to the web app.
• Pupils’ accounts are created by the school or on its behalf. Schools that prefer not to use pupils’ real email addresses may use pseudonymous ones, and we recommend doing so. For these accounts the school is the data controller and Eduvara acts as a data processor on its behalf.
• When you visit the site: our hosting provider records technical data such as IP address and browser type, needed to show the pages and protect them from abuse.
• Cookies: we do not use advertising or profiling cookies, or third-party analytics. When you log in, the web app uses the technical cookies needed to keep you signed in. The language you choose is stored in your browser’s memory.

3. Why we use it and on what legal basis

• To reply to your request. Legal basis: your consent, given by ticking the box on the form (Art. 6(1)(a) GDPR), and the steps needed to respond to your request (Art. 6(1)(b)).
• To provide the service to licensed schools: activation and running of the web app, support and renewal notices. Legal basis: the contract with the school or with its reseller (Art. 6(1)(b)).
• To send you news about our products, only if you have given separate consent, which you can withdraw at any time (Art. 6(1)(a)).
• To keep the site secure and working. Legal basis: our legitimate interest (Art. 6(1)(f)).

We do not use your data for profiling or for automated decisions.

4. Who can see it

Only Eduvara. We rely on providers that process data on our behalf and are contractually bound to protect it: Google (Google Workspace, where we keep requests and from which our emails are sent) and Hostinger (hosting of the website and of the web app). If you buy through a reseller, the reseller handles your order under its own privacy policy. We do not sell or give your data to anyone.

5. Where it is stored

Eduvara is based in the United Kingdom. The transfer of data from the European Union to the United Kingdom relies on the European Commission’s adequacy decision or, failing that, on standard contractual clauses. Our providers may also process data in the United States: in that case the transfer takes place with the safeguards required by the GDPR, such as the EU-U.S. Data Privacy Framework, which Google has joined, or the European Commission’s standard contractual clauses.

6. How long we keep it

• Requests that do not become a licence: 24 months from the request, then we delete them. If you ask us sooner, we delete them within 30 days.
• Accounts: for as long as the licence is active and for 12 months after it ends, to make reactivation easy, unless the school asks us to delete them sooner.
• Contract and accounting documents: for the period required by law.
• Technical browsing data: only for as long as the providers need it for security.

7. Your rights

You can ask us at any time to access your data, correct it, delete it, restrict its use, receive it in a machine-readable format or object to its processing. You can also withdraw your consent, without affecting what was done before the withdrawal. Just write to info@happyenglishkids.app. We reply within one month.

If you believe your data is not being handled correctly you can contact a supervisory authority: in the United Kingdom the Information Commissioner’s Office (ico.org.uk), in Italy the Garante per la protezione dei dati personali (garanteprivacy.it), or the authority of the country where you live. We would appreciate the chance to deal with your concerns first.

8. Children

The website, the request form and the Teacher Portal are intended for adults: teachers, head teachers, school staff, resellers and parents. Children use Happy English Kids at school, guided by their teacher, through accounts managed by the school. We do not ask children for personal data.

9. Changes

If we change this policy we update the date at the top. If the change affects how we use your data, we tell you first by email.

2. Quali dati raccogliamo

• Quando ci mandi una richiesta (informazioni o preventivo): nome, scuola o ente, email, ruolo, paese, il tuo messaggio, la lingua della pagina, la data della richiesta e il consenso che hai dato.
• Quando creiamo un account per te (licenza): nome, email, scuola, la licenza assegnata e i log tecnici di accesso alla web app.
• Gli account degli alunni sono creati dalla scuola o per suo conto. Le scuole che preferiscono non usare le email reali degli alunni possono usare indirizzi pseudonimi, e lo consigliamo. Per questi account il titolare del trattamento è la scuola ed Eduvara agisce come responsabile del trattamento per suo conto.
• Quando visiti il sito: il fornitore che lo ospita registra dati tecnici come indirizzo IP e tipo di browser, necessari per mostrare le pagine e proteggerle da abusi.
• Cookie: non usiamo cookie pubblicitari o di profilazione, né statistiche di terze parti. Quando accedi, la web app usa i cookie tecnici necessari per mantenerti collegato. La lingua che scegli resta nella memoria del tuo browser.

3. Perché li usiamo e su quale base

• Per rispondere alla tua richiesta. Base giuridica: il tuo consenso, che dai spuntando la casella del modulo (art. 6.1.a GDPR), e le misure necessarie per dare seguito alla tua richiesta (art. 6.1.b).
• Per fornire il servizio alle scuole con licenza: attivazione e funzionamento della web app, assistenza e avvisi di rinnovo. Base giuridica: il contratto con la scuola o con il suo rivenditore (art. 6.1.b).
• Per mandarti novità sui nostri prodotti, solo se hai dato un consenso separato, che puoi revocare quando vuoi (art. 6.1.a).
• Per tenere il sito sicuro e funzionante. Base giuridica: il nostro legittimo interesse (art. 6.1.f).

Non usiamo i tuoi dati per profilarti né per decisioni automatizzate.

4. Chi può vederli

Solo Eduvara. Ci appoggiamo a fornitori che trattano i dati per nostro conto e sono vincolati per contratto a proteggerli: Google (Google Workspace, dove conserviamo le richieste e da cui partono le nostre email) e Hostinger (hosting del sito e della web app). Se acquisti tramite un rivenditore, il rivenditore gestisce il tuo ordine secondo la propria informativa privacy. Non vendiamo né cediamo i tuoi dati a nessuno.

5. Dove si trovano

Eduvara ha sede nel Regno Unito. Il trasferimento dei dati dall’Unione europea al Regno Unito si basa sulla decisione di adeguatezza della Commissione europea o, in sua assenza, sulle clausole contrattuali standard. 6. Per quanto tempo

• Richieste che non diventano una licenza: 24 mesi dalla richiesta, poi le cancelliamo. Se ce lo chiedi prima, le eliminiamo entro 30 giorni.
• Account: finché la licenza è attiva e per 12 mesi dopo la sua fine, per rendere semplice la riattivazione, salvo che la scuola chieda di cancellarli prima.
• Documenti contrattuali e contabili: per il periodo richiesto dalla legge.
• Dati tecnici di navigazione: solo per il tempo che serve ai fornitori per la sicurezza.

7. I tuoi diritti

Puoi chiederci in qualsiasi momento di accedere ai tuoi dati, correggerli, cancellarli, limitarne l’uso, riceverli in un formato leggibile da un computer o opporti al loro trattamento. Puoi anche revocare il consenso, senza conseguenze su quanto fatto prima della revoca. Basta scrivere a info@happyenglishkids.app. Rispondiamo entro un mese.

Se ritieni che i tuoi dati siano trattati in modo non corretto puoi rivolgerti a un’autorità di controllo: nel Regno Unito l’Information Commissioner’s Office (ico.org.uk), in Italia il Garante per la protezione dei dati personali (garanteprivacy.it), oppure l’autorità del paese in cui vivi. Ti saremmo grati se ci dessi prima la possibilità di risolvere il problema.

8. Minori

Il sito, il modulo di richiesta e il Portale Insegnante sono pensati per adulti: insegnanti, dirigenti, personale scolastico, rivenditori e genitori. I bambini usano Happy English Kids a scuola, guidati dall’insegnante, con account gestiti dalla scuola. Non chiediamo dati personali ai bambini.

9. Modifiche

Se cambiamo questa informativa aggiorniamo la data in alto. Se il cambiamento riguarda il modo in cui usiamo i tuoi dati, te lo comunichiamo prima via email.

2. Qué datos recogemos

• Cuando nos envías una solicitud (información o presupuesto): nombre, centro u organización, email, cargo, país, tu mensaje, el idioma de la página, la fecha de la solicitud y el consentimiento que has dado.
• Cuando creamos una cuenta para ti (licencia): nombre, email, centro, la licencia asignada y los registros técnicos de acceso a la web app.
• Las cuentas de los alumnos las crea el centro o se crean en su nombre. Los centros que prefieran no usar las direcciones de email reales de los alumnos pueden usar direcciones seudónimas, y lo recomendamos. Para estas cuentas el responsable del tratamiento es el centro y Eduvara actúa como encargado del tratamiento por cuenta suya.
• Cuando visitas el sitio: el proveedor que lo aloja registra datos técnicos como la dirección IP y el tipo de navegador, necesarios para mostrar las páginas y protegerlas de abusos.
• Cookies: no usamos cookies publicitarias ni de perfilado, ni estadísticas de terceros. Cuando inicias sesión, la web app usa las cookies técnicas necesarias para mantenerte conectado. El idioma que eliges se guarda en la memoria de tu navegador.

3. Para qué los usamos y con qué base legal

• Para responder a tu solicitud. Base legal: tu consentimiento, que das marcando la casilla del formulario (art. 6.1.a RGPD), y las medidas necesarias para atender tu solicitud (art. 6.1.b).
• Para prestar el servicio a los centros con licencia: activación y funcionamiento de la web app, asistencia y avisos de renovación. Base legal: el contrato con el centro o con su distribuidor (art. 6.1.b).
• Para enviarte novedades sobre nuestros productos, solo si has dado un consentimiento separado, que puedes retirar en cualquier momento (art. 6.1.a).
• Para mantener el sitio seguro y en funcionamiento. Base legal: nuestro interés legítimo (art. 6.1.f).

No usamos tus datos para elaborar perfiles ni para tomar decisiones automatizadas.

4. Quién puede verlos

Solo Eduvara. Nos apoyamos en proveedores que tratan los datos por cuenta nuestra y están obligados por contrato a protegerlos: Google (Google Workspace, donde guardamos las solicitudes y desde donde salen nuestros emails) y Hostinger (alojamiento del sitio y de la web app). Si compras a través de un distribuidor, el distribuidor gestiona tu pedido según su propia política de privacidad. No vendemos ni cedemos tus datos a nadie.

5. Dónde se encuentran

Eduvara tiene su sede en el Reino Unido. La transferencia de datos desde la Unión Europea al Reino Unido se basa en la decisión de adecuación de la Comisión Europea o, en su defecto, en las cláusulas contractuales tipo. Nuestros proveedores pueden tratar datos también en Estados Unidos: en ese caso la transferencia se realiza con las garantías previstas por el RGPD, como el Marco de Privacidad de Datos UE-EE. UU., al que está adherido Google, o las cláusulas contractuales tipo de la Comisión Europea.

6. Durante cuánto tiempo

• Solicitudes que no se convierten en licencia: 24 meses desde la solicitud; después las eliminamos. Si nos lo pides antes, las eliminamos en un plazo de 30 días.
• Cuentas: mientras la licencia esté activa y durante los 12 meses siguientes a su fin, para facilitar la reactivación, salvo que el centro pida eliminarlas antes.
• Documentos contractuales y contables: durante el periodo exigido por la ley.
• Datos técnicos de navegación: solo durante el tiempo que los proveedores necesitan por seguridad.

7. Tus derechos

Puedes pedirnos en cualquier momento acceder a tus datos, corregirlos, eliminarlos, limitar su uso, recibirlos en un formato legible por máquina u oponerte a su tratamiento. También puedes retirar tu consentimiento, sin que ello afecte a lo hecho antes de la retirada. Basta con escribir a info@happyenglishkids.app. Respondemos en el plazo de un mes.

Si crees que tus datos no se tratan correctamente puedes dirigirte a una autoridad de control: en el Reino Unido la Information Commissioner’s Office (ico.org.uk), en España la Agencia Española de Protección de Datos (aepd.es), o la autoridad del país en el que vives. Te agradeceríamos que nos dieras antes la oportunidad de resolver el problema.

8. Menores

El sitio, el formulario de solicitud y el Portal Docente están pensados para adultos: docentes, directores, personal del centro, distribuidores y familias. Los niños usan Happy English Kids en el colegio, guiados por su docente, con cuentas gestionadas por el centro. No pedimos datos personales a los niños.

9. Cambios

Si cambiamos esta política actualizamos la fecha de arriba. Si el cambio afecta a cómo usamos tus datos, te lo comunicamos antes por email.

• Wenn Sie die Website besuchen: Unser Hosting-Anbieter erfasst technische Daten wie IP-Adresse und Browsertyp, die nötig sind, um die Seiten anzuzeigen und vor Missbrauch zu schützen.

• Konten: solange die Lizenz aktiv ist und 12 Monate nach ihrem Ende, um eine Reaktivierung zu erleichtern, sofern die Schule nicht eine frühere Löschung verlangt.
• Vertrags- und Buchhaltungsunterlagen: für die gesetzlich vorgeschriebene Dauer.
• Technische Nutzungsdaten: nur so lange, wie die Anbieter sie für die Sicherheit benötigen.

7. Ihre Rechte

Sie können jederzeit Auskunft über Ihre Daten verlangen, sie berichtigen oder löschen lassen, ihre Verarbeitung einschränken, sie in einem maschinenlesbaren Format erhalten oder der Verarbeitung widersprechen. Sie können auch Ihre Einwilligung widerrufen, ohne dass dies die bis zum Widerruf erfolgte Verarbeitung berührt. Schreiben Sie einfach an info@happyenglishkids.app. Wir antworten innerhalb eines Monats.

Die Website, das Anfrageformular und das Lehrerportal richten sich an Erwachsene: Lehrkräfte, Schulleitungen, Schulpersonal, Fachhändler und Eltern. Kinder nutzen Happy English Kids in der Schule, angeleitet von ihrer Lehrkraft, über Konten, die die Schule verwaltet. Wir fragen Kinder nicht nach personenbezogenen Daten.

9. Änderungen

All intellectual property rights in our web application and all material on our website are owned by us. This includes, but is not limited to, videos, lessons, curriculums, cards, games, and logos. Unauthorised use of this content is strictly prohibited.

Access to the Service

Access to our Service is permitted on a subscription basis. The termination of a subscription will result in the termination of access to the Service. Misconduct, including but not limited to the use of the same account by multiple users, may result in immediate termination of access to the Service.

User Account

To use the Service, users must have an account linked to an email address. Schools that prefer not to use pupils’ actual email addresses may use pseudonym email addresses, understanding that in the event of password changes or account recovery, they must reach out to us directly for assistance.

Data Protection

EDUVARA LTD respects and is committed to protecting the privacy of its users. We collect and process personal data in compliance with the UK GDPR, the EU General Data Protection Regulation (GDPR) and other relevant legislation. Changes to Terms

We reserve the right to modify these Terms at any time. We advise users to check this page regularly. Your continued use of the Service after changes to these Terms constitutes agreement to those changes.

EDUVARA LTD rispetta e si impegna a proteggere la privacy dei suoi utenti. Raccogliamo e trattiamo i dati personali nel rispetto dello UK GDPR, del Regolamento generale sulla protezione dei dati dell’Unione europea (GDPR) e delle altre norme applicabili. 1. Cancellation of Subscription

If you wish to cancel your subscription, the legal representative of your institution should send an email to info@happyenglishkids.app stating your intention to cancel. We do not impose a deadline for cancellation; however, we or our resellers will contact you prior to the end of your subscription to inquire about renewal. There are no fees associated with cancellation. Please note that we do not offer prorated refunds if you choose to cancel your subscription in the middle of a billing cycle.

2. Amendment of Subscription

If you wish to amend your subscription, such as extending or upgrading it, you can do so by sending an email to info@happyenglishkids.app. Amendments can be made at any time during your subscription period. If you choose to upgrade to a larger package, we will calculate the cost difference and provide you with a quote for the additional amount.

3. Data Retention after Cancellation

In the event of subscription cancellation, unless differently requested by the customer, we will retain your data for 12 months. This is to facilitate a smooth reactivation of the service should you wish to renew your subscription within this period.

4. Changes to our Cancellation and Amendment Policy

We reserve the right to change this policy at any time. If we make changes, we will notify you via the email you or your reseller provided during the purchase of your subscription.

1. Cancellazione dell’abbonamento

Per cancellare l’abbonamento, il legale rappresentante dell’istituto manda un’email a info@happyenglishkids.app con la richiesta di cancellazione. Non imponiamo un termine per cancellare; prima della scadenza, noi o i nostri rivenditori ti contatteremo per chiederti del rinnovo. La cancellazione non ha costi. Non sono previsti rimborsi proporzionali se cancelli l’abbonamento a metà di un periodo di fatturazione.

2. Modifica dell’abbonamento

Per modificare l’abbonamento, ad esempio per estenderlo o passare a un pacchetto più grande, basta un’email a info@happyenglishkids.app. Le modifiche si possono fare in qualsiasi momento durante l’abbonamento. Se passi a un pacchetto più grande calcoliamo la differenza e ti mandiamo un preventivo per l’importo aggiuntivo.

3. Conservazione dei dati dopo la cancellazione

In caso di cancellazione dell’abbonamento, salvo diversa richiesta del cliente, conserviamo i dati per 12 mesi. Serve a rendere semplice la riattivazione del servizio se decidi di rinnovare entro quel periodo.

4. Modifiche a questa policy

Ci riserviamo il diritto di cambiare questa policy in qualsiasi momento. Se lo facciamo, ti avvisiamo all’email che tu o il tuo rivenditore avete indicato al momento dell’acquisto.

Para cancelar la suscripción, el representante legal del centro envía un email a info@happyenglishkids.app indicando su intención de cancelar. No imponemos ningún plazo para cancelar; antes del final de la suscripción, nosotros o nuestros distribuidores te contactaremos para preguntarte por la renovación. La cancelación no tiene costes. No ofrecemos reembolsos proporcionales si cancelas la suscripción a mitad de un periodo de facturación.

2. Modificación de la suscripción

Para modificar la suscripción, por ejemplo para ampliarla o pasar a un paquete mayor, basta con enviar un email a info@happyenglishkids.app. Las modificaciones pueden hacerse en cualquier momento durante la suscripción. Si pasas a un paquete mayor, calculamos la diferencia y te enviamos un presupuesto por el importe adicional.

3. Conservación de los datos tras la cancelación

En caso de cancelación de la suscripción, salvo petición distinta del cliente, conservamos tus datos durante 12 meses. Así facilitamos la reactivación del servicio si decides renovar dentro de ese periodo.

Wir setzen keine Kündigungsfrist; vor Ablauf des Abonnements werden wir oder unsere Fachhändler Sie jedoch wegen einer Verlängerung kontaktieren. Die Kündigung ist kostenlos. Bitte beachten Sie, dass wir keine anteiligen Erstattungen leisten, wenn Sie das Abonnement mitten in einem Abrechnungszeitraum kündigen.

2. Änderung des Abonnements
